CNN —For the fourth time since she became the federal government’s top Supreme Court advocate, Solicitor General Elizabeth Prelogar is arguing an abortion-related case. When Prelogar argues before the Supreme Court, she is arguing in front of several alumni of the US Office of the Solicitor General. She also clerked for her current boss, Attorney General Merrick Garland, when he was a DC Circuit judge, before her Supreme Court clerkships. She went on to litigate Supreme Court cases for private firms and worked on special counsel Robert Mueller’s investigation. Likewise, the abortion case Prelogar argued last month could have significant consequences for federal power.

The Supreme Court appeared sharply divided on Wednesday over whether federal law should allow doctors to perform emergency abortions in states with near-total bans on the procedure, in a case that could determine access to abortion in emergency rooms across the country. The lively, two-hour argument focused on a clash between Idaho, whose law limits access to abortion unless the life of the pregnant woman is in danger, and federal law. Questioning by the justices suggested a divide along ideological — and possibly gender — lines. “What Idaho is doing is waiting for women to wait and deteriorate and suffer the lifelong health consequences with no possible upside for the fetus,” said Solicitor General Elizabeth B. Prelogar, arguing on behalf of the federal government. “It just stacks tragedy upon tragedy.”Justice Elena Kagan interjected that the current situation seemed untenable: “It can’t be the right standard of care to force somebody onto a helicopter.”

The court’s far-right wing, perhaps in an attempt to keep those two justices on their side, framed the case as a federal overreach into state power. Turner, Idaho’s attorney, shot back that mental health could essentially open a loophole. Conservatives have long opposed allowing exceptions to strict abortion bans for mental health. Justice Samuel Alito, a fellow conservative, picked up on that same theme, repeatedly pressing Prelogar to explain whether the Justice Department views mental health as a way around Idaho’s abortion ban. That is exactly the kind of political influence that the Supreme Court, especially under Roberts, has generally tried to avoid.

Read previewRussia is recruiting female convicts to bolster its war effort in Ukraine, the Kyiv Post reported, citing a Ukrainian intelligence spokesperson. The role of women in the war has expanded rapidly since Russia's full-scale invasion of Ukraine in 2022. The practice of offering convicts freedom in exchange for military service in Ukraine began under Yevgeny Prigozhin, the late founder of the mercenary Wagner Group. The high court’s ruling could also affect the federal election subversion criminal case pending against former President Donald Trump, who was also charged with the obstruction crime. The law, Justice Elena Kagan said, could have been written by Congress to limit its prohibition to evidence tampering. Unless the court rules broadly in a way that undermines the charge entirely, the case against Trump may still stick even if Fischer wins his case. The Fischer case has prompted some liberal critics of the court to demand that Thomas recuse himself. “There have been many violent protests that have interfered with proceedings,” Thomas asked Prelogar, pressing on a theme he returned to repeatedly during the arguments.

Still, in an earlier case involving a different provision of the law, the Supreme Court said it should be tethered to its original purpose. Mr. Fischer is accused of entering the Capitol around 3:24 p.m. on Jan. 6, 2021, with the counting of electoral ballots having been suspended after the initial assault. But the question for the justices is legal, not factual: Does the 2002 law cover what Mr. Fischer is accused of? Indeed, the judges in the majority in an appeals court ruling against Mr. Fischer could not agree on just what the word meant. By a 5-to-4 vote, the Supreme Court agreed.

Nijole Sadunaite, a fearless but forgiving Roman Catholic nun and anti-Soviet Lithuanian nationalist who was inspired by Pope John Paul II and publicly hailed by President Ronald Reagan, died on March 31 in Vilnius. Her death was confirmed by Sister Gerarda Elena Suliauskaite, laureate of the Freedom Prize of the Republic of Lithuania, which was also given to Sister Sadunaite in 2018 for her defense of democracy and human rights. In 1975, Sister Sadunaite (pronounced sah-DOO-nay-teh) was arrested by K.G.B. agents who had stormed an apartment where she was writing an underground newspaper, The Chronicle of the Catholic Church in Lithuania, which documented abuses against Christians in the Baltic state. “I had typed six pages when I was caught, so I effectively got one year for every page,” she told The Atlantic in 1994.

CNN —The legal battle over a controversial Texas immigration law could eventually give the Supreme Court a chance to revisit a historic ruling that largely struck down Arizona’s “show me your papers” law and reaffirmed the federal government’s “broad, undoubted power” over immigration. “It would have been incredibly difficult for the 5th Circuit to let this law stand under existing Supreme Court precedent,” she said. ‘Show me your papers’ lawThe Arizona law is a high-profile example of what happens when states attempt to take immigration policy into their own hands. Jan Brewer signed the Support Our Law Enforcement and Safe Neighborhoods Act, known as SB 1070, into law in 2010. The Supreme Court upheld the “show me your papers” part of the law and struck down the three other parts.

It's a victory for CEO Bob Iger against activist investor Nelson Peltz. AdvertisementDisney CEO Bob Iger has officially prevailed in his battle against activist investor Nelson Peltz. Disney had been expected to prevail in the Peltz proxy battle. AdvertisementThe battle, though, likely prompted Iger and the board to redouble its focus on the next Disney CEO. "Regardless of the outcome of today's vote, Trian will be watching this company's performance," Peltz said at the meeting before the decision.

Trian claims Disney's board has failed to generate sufficient returns in recent years as subscription streaming losses have mounted and traditional TV subscribers have declined. Early vote countBoth Disney and Trian received support from influential shareholders ahead of Wednesday's meeting. Roughly one-third of Disney's shareholders are retail shareholders, who historically vote in small numbers in annual meetings. The arrangement still raised questions about ValueAct's support for the company and whether Disney's board should have disclosed the prior relationship. A vote for the Disney's slate of board members will show support for Iger's performance as CEO since he returned to lead the company in November 2022. "When I sold Lucasfilm just over a decade ago, I was delighted to become a Disney shareholder because of my long-time admiration for its iconic brand and Bob Iger's leadership." And proxy advisory firm Institutional Shareholder Service recommended shareholders vote for Peltz, though not Rasulo. CNN —Justices Brett Kavanaugh and Amy Coney Barrett often link arms on cases, particularly when it comes to abortion and reproductive rights. Barrett was more active, but her queries appeared animated by the same concern for doctors who would have religious or moral objections to abortion. Speaking to Entertainment Weekly about his role in political satire miniseries “The Regime,” Grant, who has played politicians on screen, was asked whether he had ever entertained the thought of entering politics in real life. Nelson Peltz's Trian Fund Management withheld its votes from Walt Disney CEO Bob Iger when voting its shares in the bitter proxy battle the asset management firm is waging against the entertainment giant, according to sources who monitor the situation. However, it is counter to Trian's proxy recommendations, and it doesn't mesh with the public statements Peltz has made about wanting to work together with management if he is elected to the Disney board. In recent weeks, Disney has stepped up its attacks on Trian and Peltz. "Disney is stupid because I'm not trying to fire Bob Iger, I want to help him," Peltz recently told the Financial Times. The Disney board meeting will be held April 3 and Trian could change its vote between now and then.

Although it is not known what type of cancer Princess Catherine has, oncologists say that what she described in her public statement that was released on Friday — discovering a cancer during another procedure, in this case a “major abdominal surgery” — is all too common. “Unfortunately, so much of the cancer we diagnose is unexpected,” said Dr. Elena Ratner, a gynecologic oncologist at Yale Cancer Center who has diagnosed many patients with ovarian cancer, uterine cancer and cancers of the lining of the uterus. Often, Dr. Ratner says, the assumption is that the endometriosis has appeared on an ovary and caused a benign ovarian cyst. But one to two weeks later, when the supposedly benign tissue has been studied, pathologists report that they found cancer. In the statement, Princess Catherine said she was is getting “a course of preventive chemotherapy.”That, too, is common.

Proxy advisory firm Institutional Shareholder Services on Thursday recommended that Walt Disney shareholders elect activist investor Nelson Peltz to the board in his bitter fight against CEO Bob Iger. While siding with Peltz, ISS told shareholders not to back Rasulo in the fight, citing his previous positioning as a potential successor to Iger. "Though we do not have any concerns about his ability to serve as an objective director, we recognize that Rasulo's potential presence might create added friction on the board," ISS said. Another proxy advisory firm, Glass Lewis, earlier this week endorsed Disney's slate of board nominees. Large institutional shareholders will often — but not always — vote based on the recommendation of either of the two proxy advisory firms.
